Maybe it's just me but I feel nopan should be used in case where panties are expected but missing. Nudes, having sex, bathing, nude swimming, any situation where you would normally not have panties should not be tagged as no panties. If subject is riding a bike in skirt and flashes parts then that would be nopan. Girl on escalator or stars in a skirt and no panties then nopan. Shorts giving peeks of parts and no panties, then obviously nopan. Is this right or wrong?
Have you already read the wiki for no panties? I think that explains it pretty well.
To put it simply, no panties is meant for any character wearing a skirt, dress, shorts, pants, or similar articles of clothing that cover the lower half of the body, but without any sort of underwear underneath. All of the scenarios you mentioned shouldn't be tagged no panties as the characters wouldn't be wearing any clothes, except for sex, because you don't need to undress to have sex.
Yes, the tag is a mess, like many others (looking at you, upskirt). I clean posts out of it regularly. It gets used together with bottomless a lot despite the two tags being mutually exclusive.
I rewrote the no panties wiki to be more in line with the no bra wiki, which more explicitly says it's not to be used when the character isn't expected to be wearing a bra.
The tag does need extensive cleanup. It's frequently misused by overzealous taggers who take every tag literally and don't think about what they actually mean.

To clarify, does that include sex? Because I would actually like to be able to find posts of characters lacking underwear, but still clothed otherwise, during sex.
It can be used for sex, for example clothed sex when the character is wearing a skirt or dress but no underwear. If you're still wearing bottoms then underwear is still expected. If you're not wearing any clothes then no underwear is expected.
I don't think we have a tag precisely for what OP has in mind, which seems to be accidental flashes of nopan in everyday situations, like a pantyshot but with no panties. The closest would be upskirt+no panties or pussy peek+no panties, but neither really does the job.
