Good question. It should probably be reworded to make the suggestion to read howto:rate stronger and the summary less unambiguously "this is always explicit".
There are some lines that I find problematic:
Safe: Clearly non-sexual nudity.
This is a potential ambiguity landmine. It's just me, but omitting the line and let people draw their own conclusions after reading the nudity requirements for Questionable/Explicit by process of elimination may be better.
Questionable: Actual intercourse, if portrayed in a restrained and tasteful manner (this can be tricky and is necessarily a judgement call, but if it concentrates on the act and omits anatomical details, it's likely okay)
I don't recall discussing this. Sex, softcore or hardcore, was always rated Explicit.

I might not've mentioned sex outright, but it follows the general guidelines and the reasoning behind them I laid out in the threads that lead up to the revised howto:rate. Compare:
It's no different from non-sexual nudity being safe. And changing how things were "always rated" is the entire point of revising the standards.
